Terms of Service

These terms govern your use of Bondipos, a point-of-sale service available at bondipos.com (the “Service”), operated byJadon Irwin trading as JP Irwin Academy (ABN 68 645 483 536) (“we”, “us”). By creating an account or using the Service you agree to these terms on behalf of yourself and the business you register.
1. The Service
Bondipos records sales, refunds, stock levels, GST amounts and related business data for your shop. Bondipos is a record-keeping tool only: it does not process card payments, move money, or connect to payment terminals. You take payment from your customers by your own means; Bondipos records that it happened.
2. Accounts and staff
- You must provide accurate account details and keep your password and staff PINs confidential.
- The account owner is responsible for all activity under their shop, including activity by staff members they add.
- You must be at least 18 and authorised to act for the registered business.
3. Trial, fees and billing
- New shops receive a 14-day free trial. No payment details are needed to start.
- After the trial, continued use requires a paid subscription, billed monthly in advance in Australian dollars through our payment provider, Stripe. Prices are shown at the point of purchase and include GST where applicable.
- If the trial ends or a subscription lapses without payment, access to the till is suspended. Your data is retained and access resumes when a subscription becomes active.
- You may cancel at any time; cancellation takes effect at the end of the paid period. Fees already paid are non-refundable except where the Australian Consumer Law requires otherwise.
- We may change pricing with at least 30 days’ notice.
4. Your data
- Your business data (products, sales, staff records) belongs to you. We use it only to operate and improve the Service, as described in our Privacy Policy.
- You can request an export of your data at any time while your account is in good standing.
- You are responsible for the accuracy of what you enter and for meeting your own record-keeping obligations (for example, under Australian tax law).
5. GST figures are not tax advice
Bondipos calculates GST from the prices and tax settings you enter (treating marked prices as GST-inclusive). These figures are an aid to your record keeping, not tax, legal or accounting advice. Verify your obligations with your accountant or the ATO. You remain solely responsible for your tax reporting.
6. Acceptable use
You must not:
- use the Service for unlawful activity or to record fraudulent transactions;
- attempt to access another shop’s data or probe, disable or overload the Service;
- resell or sublicense the Service without our written consent;
- reverse engineer the Service except as permitted by law.
7. Availability
We aim for high availability but the Service is provided on an “as available” basis and outages can occur. The till’s offline mode queues sales on your device when the connection drops, but you should maintain your own contingency for taking payment. We may perform maintenance, and may modify features, with reasonable notice of material changes.
8. Liability and indemnity
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded (your “non-excludable rights”). The Service is software of a kind ordinarily acquired for business use; where we are liable for failing to meet a consumer guarantee in connection with it, and the law permits us to limit that liability, our liability is limited (at our option) to supplying the Service again or paying the cost of having it supplied again. Subject to your non-excludable rights:
- the Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including any implied warranty that it will be uninterrupted, error-free, or fit for a particular purpose;
- Bondipos is a record-keeping tool that does not take payment or move money. We are not responsible for how you collect, count, bank or reconcile your takings, for the acts or omissions of your staff, or for your own devices, scanners, printers, or internet connection;
- we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, sales, goodwill, anticipated savings, business opportunity or business interruption, or for any loss, corruption or inaccuracy of data, however caused;
- our total aggregate liability arising out of or in connection with the Service and these terms — whether in contract, tort (including negligence), under statute or on any other basis — is limited to the greater of the fees you actually paid us for the Service in the 12 months immediately before the event giving rise to the liability, or AUD 100;
- we are not liable for the acts, omissions, failures or outages of third parties or services outside our reasonable control, including your payment provider (Stripe), your bank, or your internet, device or hosting providers;
- to the extent the law allows, you must commence any claim against us within 12 months after the event giving rise to it; and
- these limitations apply to the fullest extent permitted by law and survive termination of your account.
You indemnify us against loss, damage, liability and reasonable costs we reasonably incur from a third-party claim, to the extent it arises from your unlawful or fraudulent use of the Service, your breach of these terms, or the data or content you enter infringing someone else’s rights. This indemnity does not apply to the extent the loss was caused by our own breach, negligence or wrongful act, and it does not require you to give up any of your non-excludable rights.
9. Suspension and termination
We may suspend or terminate an account that breaches these terms, with notice where practicable. You may close your account at any time. On closure we retain data for a reasonable period (so you can change your mind or export it), then delete it in the ordinary course, except records we must keep by law.
10. Changes to these terms
We may update these terms from time to time. Material changes will be notified by email or in the app at least 14 days before they take effect. Continued use after that date is acceptance of the new terms.
11. Governing law
These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have non-exclusive jurisdiction.
